Jellybelly Art Shop is operated by Isabelle Laureta (ABN 95857837405), a sole trader based in New South Wales, Australia. In these terms, "I", "me" and "my" mean Isabelle Laureta trading as Jellybelly Art Shop, and "you" means you, the customer.

By using this website or placing an order, you agree to these terms. If you don't agree with them, please don't use the site.

Placing an order

Adding something to your cart and paying is an offer to buy, not a completed sale. The sale is complete when I confirm your order and dispatch it.

I may decline or cancel an order — and will refund you in full if I do — where an item is unavailable, a price or description was wrong, payment can't be verified, or I reasonably suspect fraud. If a price is obviously and significantly wrong, I'm not obliged to sell at that price; I'll tell you and give you the choice of paying the correct price or a full refund.

Prices and payment

All prices are in Australian dollars (AUD).

I am not currently registered for GST, so no GST is charged on your order.

Prices may change at any time, but a change will never affect an order you've already placed. Payment is taken at checkout through Shopify's payment providers — I never see or store your full card details.

About the artwork

Every piece on this site is my own original work.

Prints are made to order on Hahnemühle German Etching — 310gsm, acid-free and archival — at a fine-art printing lab, and posted from the one nearest you. Sizes are stated as A5, A4 and A3, and prints are sent unframed. Where an artwork is photographed in a frame, the frame is for display and isn't included unless the listing explicitly says so.

Original paintings are one-of-a-kind. Once one sells, it's gone. Details of medium, size and framing are on each listing.

Colour. Screens differ, and paper is not a screen. I photograph and proof everything as faithfully as I can, but there will be small variations between what you see on your device and what arrives. Slight variation between individual prints is normal for this kind of paper and is part of how it looks, not a fault.

Copyright and how you may use the artwork

I retain full copyright and all intellectual property rights in every artwork, image, and piece of writing on this site. Buying a print or an original buys you the physical object — it does not transfer copyright or any right of reproduction.

You may display what you've bought in your home or workplace, and resell the physical item you own.

You may not, without my written permission:

reproduce, scan, photograph for reproduction, copy or print the artwork
use it commercially, including in advertising, packaging, merchandise or products for sale
distribute or sell digital copies of it in any form
create derivative works from it
use it to train, fine-tune or develop machine-learning or generative AI systems

Site content — text, photographs, layout — is likewise mine and may not be copied or scraped for reuse.

Commissions

Commissions are agreed individually in writing before I start, covering scope, price, timeline, number of revisions, and any deposit. Those written terms sit alongside these ones. Deposits are non-refundable once work has begun, unless I fail to deliver what was agreed. Copyright in a commissioned work stays with me unless we agree otherwise in writing.

Shipping, returns and refunds

Delivery is covered by the Shipping Policy and returns by the Return & Refund Policy. Both form part of these terms.

Your Australian Consumer Law rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If you're outside Australia, your local consumer law may give you further rights, and these terms don't take those away either.

Limits on my liability

To the extent permitted by law, and always subject to the section immediately above, my total liability to you for any claim connected with an order is limited to the amount you paid for that order. I'm not liable for indirect or consequential loss.

I don't guarantee the website will always be available, uninterrupted or free of errors, and I may change or remove products, prices and content at any time.

Accounts

If you create an account, keep your password to yourself — you're responsible for what happens under it. Tell me if you think someone else has access.

Privacy

Changes to these terms

I may update these terms. The version in force is the one published here when you place your order, and changes don't apply retrospectively to orders already placed.

Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction. This does not deprive you of the protection of any mandatory consumer law in the country where you live.
